By accessing and using the F.I.T. Love AI website, mobile application, or any services provided by F.I.T. Love AI ("we," "our," "us," "Service"), you agree to be legally bound by these Terms & Conditions. If you do not agree to these terms, please do not use this Service. Your continued use of the Service constitutes acceptance of these Terms.

2. Use License and Restrictions

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use only.

You may NOT:

• Use the Service for any commercial purpose or public display

Data Access and Export: You may access, review, and export your personal assessment data and profile information for personal use. You may request deletion of your account and all associated data (see Privacy Policy).

3. User Accounts and Security

Account Responsibility

You are responsible for:

• Maintaining the confidentiality of your password and account credentials
• All activity and transactions that occur under your account
• Notifying us immediately of any unauthorized access or security breach

Account Termination

You may terminate your account at any time by contacting us. Upon termination, we will delete your data in accordance with our Privacy Policy.

4. Partner Connection and Data Sharing

Consent to Share Data

When you connect with a partner in the Service:

• You agree to share your relationship profile, assessment results, and related data with your connected partner
• Your partner can see your shared relationship information in real-time
• Both partners must opt-in to the connection
• Either partner may disconnect at any time, which stops real-time data sharing going forward

Responsibility for Partner Data

You are responsible for ensuring your partner consents to data sharing before connecting. F.I.T. Love AI is not responsible for disputes between partners regarding shared data.

Partner Account Deletion

If your partner deletes their account, your shared relationship data remains in your account, but updates from them will stop syncing. Discuss data handling with your partner before deletion.

5. Disclaimer of Warranties

The Service is provided "AS IS" without warranties of any kind, express or implied. We make no warranties that:

• The Service will be uninterrupted, error-free, or free of viruses
• The Service will meet your expectations or requirements
• Any information or content is accurate, complete, or current
• The Service is suitable for any particular purpose
• AI-generated recommendations are reliable, accurate, or appropriate for your situation

DISCLAIMER: We expressly disclaim all warranties including merchantability, fitness for a particular purpose, title, and non-infringement of intellectual property rights.

6. AI-Generated Content Disclaimer

AI-Generated Recommendations:

• Are NOT professional advice
• Are NOT a substitute for therapy, counseling, or medical care
• May contain errors, inaccuracies, or biases
• Are NOT provided by licensed or certified professionals
• Should NOT be the sole basis for important life decisions
• Should NOT be used in crisis situations

Limitations

We do NOT use your personal data to train AI models. However, we do use assessment responses and relationship context (de-identified) to generate coaching advice per our Privacy Policy.

Your Responsibility

You assume full responsibility for evaluating the appropriateness and reliability of any AI-generated recommendations before acting on them.

7. NOT a Licensed Professional Service

F.I.T. Love AI IS NOT:

• A licensed therapy or counseling service
• Provided or endorsed by licensed mental health professionals
• A substitute for professional mental health care
• Certified, accredited, or regulated by any mental health board
• Appropriate for mental health crises, abuse, or emergencies

If you are experiencing a mental health crisis, relationship abuse, suicidal thoughts, or other serious issues, please contact:

8. Limitations of Liability

• Loss of data, profits, revenue, goodwill, or business opportunity
• Damages arising from your use or inability to use the Service
• Damages from reliance on AI-generated recommendations
• Relationship conflicts or outcomes resulting from Service use
• Third-party claims or actions

This applies even if we have been notified of the possibility of such damages.

Some jurisdictions do not allow limitation of liability, so this limitation may not apply to you.

9. Accuracy of Materials

We make no warranty regarding the accuracy, completeness, or timeliness of content on our website or in the Service. We may update or change materials at any time without notice. You should not rely on materials as current without independent verification.

10. Intellectual Property Rights

Ownership

All content, materials, software, designs, text, images, and other intellectual property on the Service (except user-generated content) are owned by F.I.T. Love AI or our suppliers and are protected by copyright and trademark laws.

License Grant

User-Generated Content

You retain all rights to content you submit (assessment responses, profile information, messages). By submitting content, you grant F.I.T. Love AI a worldwide, royalty-free license to:

• Store, process, and display your content
• Use aggregate or anonymized versions of your data for analytics and service improvement
• Share your assessment results with your connected partner

We do NOT use your personal data or content to train AI models.

11. Copyright and DMCA

If you believe any material on the Service infringes your copyright or intellectual property rights, please notify us with:

• Your name, address, and contact information
• Description of the copyrighted work
• Location of the material on the Service
• Statement that you have a good-faith belief the use is not authorized

12. Third-Party Services

The Service uses third-party services including:

• Anthropic's Claude AI: Processes assessment data to generate recommendations (see Anthropic Privacy Policy)
• Google Firebase: Stores and manages your data (see Firebase Terms)
• Amazon Associates Program: Affiliate product links and recommendations (see Amazon Associates Operating Agreement)

These services are subject to their own terms and conditions. We are not responsible for their practices or policies.

13. Amazon Affiliate Links

F.I.T. Love AI may include affiliate links to Amazon products in:

• AI coaching recommendations
• Website content and articles
• In-app relationship resource suggestions

How it works:

• When you click an affiliate link and make a purchase, F.I.T. Love AI earns a commission at no additional cost to you
• Affiliate commissions do not influence our recommendations or advice
• Product suggestions are for entertainment and informational purposes only and do not constitute professional advice or endorsement
• Your purchase is governed by Amazon's terms, not ours

We are a participant in the Amazon Associates Program and other affiliate networks.

14. Payment, Billing, and Refunds

Free and Paid Tiers

F.I.T. Love AI offers both free and paid access levels:

• Free Tier: Limited daily AI coaching requests, ad-supported
• Pay-as-You-Go: Individual premium AI requests at specified rates
• Subscription: Monthly subscription options for unlimited premium requests and increased daily free allowances (no ads)

Billing Terms

Your choice of tier and any subscription are subject to the following:

• Billing: Charges are made to your chosen payment method on the billing cycle you select.
• Refunds:
  • Subscription refunds are issued within 30 days of cancellation for proportional unused service, minus any applicable fees
  • Pay-as-you-go purchases are non-refundable
  • Assessment creation is always unlimited and non-refundable
• Cancellation: You may cancel your paid subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of your current billing period.
• Changes to Pricing: We may change prices for future billing periods with 30 days' notice. Existing subscriptions continue at current pricing until renewal.
• Payment Failure: If payment fails, we may suspend your account until payment is successful.
• Free Trial: If offered, free trial periods are subject to terms provided at signup. Trial access converts to your chosen paid tier unless cancelled before the trial ends.

15. Termination of Service

Your Termination

You may terminate your account at any time by contacting us.

Our Termination

We may suspend or terminate your account for:

• Violation of these Terms
• Illegal activity or abuse
• Non-payment (for paid tiers)
• Inactivity (90+ days without login)
• Request from law enforcement or legal process

We will provide reasonable notice (at least 14 days) before termination except in cases of severe breach, illegal activity, abuse, or legal obligation.

Data Upon Termination

Upon account termination, we will delete your personal data within 30 days in accordance with our Privacy Policy. Partners will no longer see updates from your account, but they may retain copies of data already synced to their accounts.

16. Indemnification

You agree to indemnify and hold harmless F.I.T. Love AI and its founders, employees, and agents from any claims, damages, losses, or expenses (including attorney's fees) arising from:

• Your violation of these Terms
• Your use of the Service
• Your violation of any laws or rights of others
• Disputes between you and your partner
• Reliance on AI-generated recommendations
• Your use of affiliate product recommendations

17. Changes to Terms and Service

We may update these Terms at any time. Material changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

We may also change or discontinue features of the Service at any time with reasonable notice.

18. Dispute Resolution

Informal Resolution

If you have a dispute with F.I.T. Love AI, please contact us at fitloveadvisor@gmail.com with a detailed description of the issue. We will attempt to resolve disputes informally within 30 days.

Binding Arbitration

If informal resolution fails, you and F.I.T. Love AI agree to resolve disputes through final and binding arbitration rather than court proceedings, except for claims involving intellectual property infringement, injunctive relief, or claims brought in small claims court.

Arbitration Details:

• Arbitration will be conducted by JAMS (Judicial Arbitration and Mediation Services) under its Streamlined Arbitration Rules & Procedures
• Arbitration will occur in Broward County, Florida (or by mutual agreement at another location)
• Each party bears its own attorney's fees and costs; arbitrator fees are split equally
• The arbitrator may award the same damages and relief available in court
• The arbitrator's decision is final and binding

Class Action Waiver

You and F.I.T. Love AI agree that arbitration will be on an individual basis. You may not bring claims as a plaintiff or class member in any class, collective, or representative action.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and F.I.T. Love AI regarding the Service and supersede all prior agreements, understandings, and representations.

21. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Florida, without regard to conflicts of law principles. You irrevocably submit to the exclusive jurisdiction of the state and federal courts located in Broward County, Florida for any disputes that are not resolved through arbitration.
